A minor dwelling is generally defined as a dwelling that is ‘secondary to the principal dwelling on the site’ – i.e., a self contained unit that is built on the same site as an existing residential house. It must contain a kitchen or food preparation facility, and it must also be designed and used specifically for a residential purpose – this means detached home offices or studies don’t apply.
In Auckland, any secondary dwelling that contains a bedroom and/or a bathroom, but not a kitchen or cooking facilities, is considered an ‘accessory building’, rather than a minor dwelling. A sleepout would fall under this category, as they are generally defined as sharing cooking facilities with the main dwelling.
While different territorial authorities have different regulations, in general a minor dwelling must not exceed 60sqm or 65sqm, depending on the size of the site and the zoning requirements in the area in which you are building.
In Auckland, for example, a minor dwelling must not exceed a floor area of 65sqm excluding decks and garages. It must also have an outdoor living space of at least 5sqm for a studio or one-bedroom dwelling, and 8sqm for a two or more bedroom dwelling.
